Your privacy matters to us. This policy explains how Vitalis Health Enterprises LLC, doing business as Vitalis Health & Performance, handles personal information across our website, appointment experience, and communications.

This Privacy Policy applies to Vitalis Health Enterprises LLC, doing business as Vitalis Health & Performance (collectively, “Vitalis,” “we,” “us,” or “our”), our website at www.vitalishealthco.com, our online forms and chat experience, and communications related to our concierge wellness services.

Vitalis serves clients in the Dallas–Fort Worth area and maintains its business registration in Austin, Texas, United States. This policy covers personal information processed through the website and our business communications. It does not replace any separate Notice of Privacy Practices that may apply to protected health information under applicable healthcare law.

2. Information We Collect

Information you provide

  • Contact information, such as your name, email address, mobile telephone number, and service location.
  • Appointment information, including requested services, scheduling preferences, and information submitted through our booking provider.
  • Communications, including questions, chat messages, support requests, SMS preferences, and records of your consent or opt-out choices.
  • Wellness information you choose to provide, such as relevant health history, symptoms, goals, or other information needed to assess whether a service may be appropriate.
  • Newsletter and promotional preferences, including your request for a welcome offer or your choice to receive marketing communications.

Information collected automatically

When you use our website, we and our service providers may automatically collect your IP address, browser and device type, operating system, referring pages, pages viewed, approximate location derived from IP address, timestamps, and interactions with the website. We may use cookies, pixels, and similar technologies to support website operation, remember preferences, understand traffic, and improve performance.

Information received from service providers

We may receive information from providers that help us operate our website, schedule appointments, manage customer relationships, deliver email or text communications, process payments, and measure site performance. The information received depends on how you interact with those services.

3. How We Use Information

We use personal information as reasonably necessary to:

  • respond to questions and provide customer support;
  • schedule, confirm, administer, and follow up on requested services;
  • conduct safety screening and personalize the client experience;
  • send service-related communications, appointment reminders, and account or transaction updates;
  • send promotional messages only when the recipient has provided the required consent;
  • maintain records of consent, communication preferences, and opt-out requests;
  • operate, secure, troubleshoot, analyze, and improve our website and services;
  • prevent fraud, misuse, or security incidents; and
  • comply with applicable legal, regulatory, professional, and recordkeeping obligations.

4. SMS and Mobile Messaging Privacy

If you separately and affirmatively opt in, Vitalis may send text messages related to appointment reminders, requested follow-ups, customer care, service updates, wellness information, special offers, or promotions consistent with the consent you selected. Consent to receive marketing text messages is optional and is not a condition of purchasing any goods or services.

Mobile information protection

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

We may provide limited mobile information to vendors that perform services on our behalf, such as communications delivery, platform hosting, or customer support. Those vendors may use the information only to provide contracted support services and not for their own marketing. Text-message enrollment information, opt-in status, and consent records are excluded from all other sharing and will not be disclosed to outside parties.

  • Message frequency: Message frequency varies based on your interactions, appointments, and communication preferences.
  • Charges: Message and data rates may apply.
  • Opt out: Reply STOP to any message to cancel. We may send one final confirmation that your opt-out was processed.

Opting out of marketing messages does not prevent us from contacting you where permitted for non-marketing purposes, such as responding to a request you initiated or sending essential service communications. SMS is not guaranteed to be secure; please do not send detailed medical information or emergency requests by text message.

5. How We Disclose Information

We disclose personal information only when reasonably necessary for legitimate business and service purposes, including:

  • Service providers: website hosting, appointment scheduling, customer relationship management, communications delivery, analytics, email services, payment processing, security, and technical support.
  • Professional and clinical support: authorized personnel and service partners involved in evaluating, arranging, or providing requested services, subject to applicable confidentiality obligations.
  • Legal and safety purposes: when required by law or reasonably necessary to protect rights, safety, property, clients, personnel, or the public.
  • Business changes: as part of a merger, financing, acquisition, restructuring, or transfer of business assets, subject to appropriate confidentiality protections.
  • At your direction: when you request or authorize a disclosure.

Mobile numbers and SMS consent data remain subject to the specific restrictions described in Section 4, regardless of the other categories in this section.

6. Service Providers and Third-Party Platforms

Our website and operations use third-party platforms that process information under their own contracts and privacy terms. These may include:

  • HighLevel/LeadConnector for website chat, customer relationship management, and communications;
  • Acuity Scheduling for appointment scheduling;
  • Google Analytics for website usage measurement;
  • Hostinger for website hosting; and
  • email, telecommunications, payment, security, and professional service providers used to support our operations.

When you leave our website or interact directly with a third-party platform, that provider’s privacy terms may also apply. We encourage you to review the provider’s policy before submitting information.

7. Health Information

Information about physical or mental health may be sensitive personal information. We limit its use to assessing requests, supporting services, meeting safety and professional obligations, and other purposes authorized by you or permitted by law. Where information is protected by the Health Insurance Portability and Accountability Act (“HIPAA”) or another healthcare privacy law, the applicable healthcare notice and legal requirements govern that information.

Website chat, ordinary email, and SMS may not provide the same protections as a dedicated clinical system. Do not use these channels for emergencies. If you are experiencing a medical emergency, call 911 or seek immediate medical care.

8. Cookies and Analytics

We use essential technologies to operate the website and may use analytics technologies to understand visits, performance, and engagement. Google Analytics may set or read identifiers and collect device and usage information. You can control cookies through your browser settings and may use available browser or provider tools to limit analytics. Blocking some technologies may affect website functionality.

Our website may also use local storage to remember preferences, such as whether a newsletter prompt was submitted or dismissed.

9. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including providing requested services, maintaining consent and opt-out records, meeting clinical or business recordkeeping requirements, resolving disputes, protecting security, and complying with law. Retention periods vary based on the type of information and applicable obligations.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no website, transmission method, or storage system can be guaranteed completely secure. You are responsible for using appropriate care when sending information online and for protecting access to your devices and accounts.

11. Your Choices and Privacy Rights

You may unsubscribe from promotional email using the link in an email and may withdraw SMS consent by replying STOP. You may also contact us to request access to, correction of, or deletion of personal information, subject to authentication and applicable legal exceptions.

Where the Texas Data Privacy and Security Act or another applicable state privacy law grants you rights, those rights may include confirming whether we process your personal data, accessing it in a portable format, correcting inaccuracies, requesting deletion, and opting out of targeted advertising, certain transfers treated as sales under applicable law, or certain profiling. You will not be discriminated against for exercising an applicable privacy right.

12. Children’s Privacy

Our website is not directed to children under 13, and we do not knowingly collect personal information online from children under 13 without legally required authorization. If you believe a child has provided personal information through the website, please contact us so we can review and address the information appropriately.
